WDI GROUP (SURREY) LTD
CONSUMER CANCELLATION & 14-DAY COOLING-OFF NOTICE
This notice is intended for consumer contracts where statutory cancellation rights apply, including qualifying distance and off-premises contracts. It should be provided with the quotation/contract information before the consumer is bound. Nothing in this notice limits statutory rights.
1. WHEN THE 14-DAY RIGHT MAY APPLY
Where a qualifying service contract is concluded at a distance or away from WDI Group's business premises, the consumer will normally have a statutory period of 14 days in which to cancel without giving a reason, subject to the applicable law and exceptions.
2. CANCELLATION PERIOD
For a qualifying service contract, the cancellation period normally expires 14 days after the day the contract is entered into. The precise statutory position will apply to the particular contract.
3. HOW TO CANCEL
To exercise a statutory right to cancel, the consumer must inform WDI Group of the decision to cancel by a clear statement before the cancellation period expires. This may be sent by email, post or another durable method accepted by WDI Group. The consumer does not have to use a particular form where the law permits another clear statement.
Suggested cancellation wording:
4. REFUNDS FOLLOWING VALID STATUTORY CANCELLATION
Where the consumer validly exercises a statutory cancellation right, WDI Group will provide any refund required by law, subject to any lawful deduction or payment due for services supplied at the consumer's express request during the cancellation period.
5. REQUEST TO START WORK WITHIN 14 DAYS
The consumer may ask WDI Group to begin providing services before the statutory cancellation period has expired. WDI Group is not required to start early and may require an express written request before doing so.
START-WORK REQUEST
6. WORK COMPLETED DURING THE CANCELLATION PERIOD
Where the consumer has made the legally required request for performance to begin during the cancellation period and the service is fully performed in circumstances where the law provides for loss of the cancellation right, the cancellation right in respect of that fully performed service may end.
7. PAYMENT FOR WORK STARTED AT THE CONSUMER'S REQUEST
If the consumer validly cancels after expressly requesting that services begin during the cancellation period, WDI Group may be entitled to payment for the proportion of the service supplied before cancellation, calculated in accordance with applicable consumer law.
8. EMERGENCY REPAIRS
Specific statutory rules and exceptions may apply to urgent repair or maintenance work requested by a consumer at their home. Any exception applies only to the extent provided by law and should not be treated as removing cancellation rights for unrelated or additional work.
9. GOODS AND MATERIALS
Where a contract includes goods or materials as well as services, different rules may apply to cancellation, return, deductions and goods made to the consumer's specifications. WDI Group will apply the statutory rules applicable to the particular contract rather than relying on this notice to remove any consumer right.
10. WDI GROUP CONTRACTUAL CANCELLATION TERMS
Any cancellation outside a statutory cooling-off right is governed by the quotation and WDI Group's applicable Terms & Conditions. Any sum retained or charged following cancellation will be limited to amounts WDI Group is legally entitled to recover, taking account of actual reasonable losses, costs already incurred and reasonable steps to reduce loss.
11. IMPORTANT
This notice is designed to support WDI Group's consumer-contract process but does not replace the statutory pre-contract information that may be required for a particular transaction. The applicable law takes priority over any inconsistent wording in this document.
Nothing in this notice affects the consumer's statutory rights.
